    Terms of Service

    1. About JobTayo

    JobTayo ("we," "us," "our") is an online marketplace connecting Filipino professionals ("Talents") with global and local clients ("Clients"). We provide discovery, profile, and communication tools. We are not an employer, staffing agency, broker, or payment intermediary.

    2. Accounts & Eligibility

    • You must be 18+ and provide accurate, current information.
    • You are responsible for activity under your account and safeguarding credentials.
    • We may suspend or terminate accounts for fraud, misuse, or violations.

    3. Platform Role

    Service Contracts are made directly between Client and Talent. We do not control work quality, delivery, timing, or outcomes and cannot guarantee placement, performance, or payment.

    4. Payments & Financial Responsibility

    • We do not process, hold, or guarantee payments.
    • Clients pay Talents directly via mutually agreed methods (e.g., Wise, bank transfer, PayPal).
    • Any payment disputes are between Client and Talent.

    5. Subscriptions & Refund Window

    • Clients pay a subscription for access to platform features; Talents pay no commissions on earnings.
    • Refunds: A Client may receive a full refund for their initial subscription if cancelled within 30 days of activation and if the Client has not activated any contract with at least one talent. After 30 days, no refunds.

    6. Independent Contractor Disclaimer

    • Talents are independent contractors, not employees, partners, or agents of JobTayo.
    • Talents are solely responsible for filing and paying taxes and contributions under Philippine law and any other applicable jurisdiction.
    • Clients are responsible for paying Talents directly and maintaining their own compliance records.

    7. Non-Circumvention

    Clients and Talents who connect through JobTayo agree not to intentionally bypass the platform solely to avoid subscription fees for the first engagement. Repeated or deliberate avoidance may lead to account action.

    8. Acceptable Use

    See our Acceptable Use Policy for detailed rules. Violations may lead to removal or bans without notice.

    9. Confidentiality & Intellectual Property

    • Clients and Talents should agree on NDAs and IP terms in their Service Contract.
    • Unless agreed otherwise, IP typically transfers upon full payment.

    10. Privacy

    We process personal data under the Philippine Data Privacy Act and GDPR where applicable. See our Privacy Policy.

    11. Mediation & Disputes

    We may offer optional, informal mediation but cannot enforce or collect payments. Users must resolve legal disputes directly.

    12. Limitations of Liability

    To the fullest extent permitted by law, we are not liable for indirect or consequential damages. If liability arises, it is capped at the total subscription fees paid by the Client in the preceding three (3) months.

    13. Indemnification

    You agree to indemnify JobTayo and its affiliates against claims arising from your use, breach, or disputes with other users.

    14. Termination

    We may suspend or terminate access for violations, fraud, or harm to the platform/community.

    15. Governing Law & Venue

    These Terms are governed by the laws of the Republic of the Philippines, with exclusive venue in Tagbilaran City, Bohol, unless otherwise required by law.

    16. Changes to These Terms

    We may amend these Terms at any time by posting updates here. Continued use constitutes acceptance.
